The harvesting of data about people, organizations, and things and their transformation into a form of capital is often described as a process of “accumulation by dispossession,” a pervasive loss of rights buttressed by predatory practices and legal violence. Yet this argument does not square well with the fact that enrollment into digital systems is often experienced as a much more benign process: signing up for a “free” service, responding to a “friend’s” invitation, or being encouraged to “share” content. In (...) this paper, we focus on the centrality of gifting and reciprocity to the business model and cultural imagination of digital capitalism. Relying on historical narratives and in-depth interviews with the designers and critics of digital systems, we explain the cultural genesis of these “give-to-get” relationships and analyze the socio-technical channels that structure them in practice. We suggest that the economic relation that develops as a result of a digital gift offering not only masks the structural asymmetry between giver and gifted but also permits the creation of the new commodity of personal data, obfuscates its true value, and naturalizes its private appropriation. In this study, we investigated the relationships between judgments of intentionality and moral evaluation in individuals with High Functioning Autism (HFA) or Asperger Syndrome (AS). HFA or AS are neurodevelopmental disorders characterised by severe deficits in communication and social functioning. Impairments in Theory of Mind (ToM), i.e., the ability to attribute mental states to oneself and to others, are thought to be the core features of autism. Of all mental states, the concept of ‘intentional action’ is particularly important. People normally (...) distinguish between actions that are performed intentionally and those that are performed unintentionally and this distinction plays a crucial role in social understanding and moral judgment. Recently, Knobe (Analysis 63: 190–193, 2003a ), (Philosophical Psychology 16: 309–324, 2003b ) showed that people’s moral evaluations might serve as input to the process by which people intuitively arrive at the intentionality judgments. Here, by using two pairs of vignettes, the Knobe’s Harm/Help cases and Murder/Bull’s-eye cases, we showed that, as already observed in typical population, in individuals with HFA/AS judgment of intentional action is informed by the moral appreciation of the action outcome. However, the two groups differed on praise judgments and moral justifications, suggesting that these processes were poorly influenced by the agent’s psychological states. We concluded that, although under certain circumstances, individuals with HFA/AS and people with typical development have similar intuitive judgments of intentionality, over-assignment of praise judgments and the reduced use of folk-psychological concepts in moral judgment likely reflect difficulties using intentionality information for moral reasoning. This qualitative field study is based on interviews with 20 experienced audit partners in France and documents the dialogical dimension of ethical deliberation in auditing. We ask: do audit partners consult each other when faced with an ethical dilemma at work? Who among their peers do they prefer to consult and why? Our analysis provides evidence that audit partners do not deliberate alone, contrary to what psychological experimental research on audit ethics usually postulates. When faced with an uncertain situation in (...) terms of professional ethics, they seek reassurance by consulting colleagues. Not just any colleagues, however. Whom they consult depends on whether they wish to avoid or take measured ethical risks. Overall, we find that audit partners approach ethics as a personal and collective risk that must be managed in specific ways. This study enriches what we know about auditor ethics by helping to shed light on what is usually inaccessible to researchers: the questions that audit partners ask their peers when faced with uncomfortable ethical issues in client engagements before making a decision they find acceptable. In this short paper we analyse some paradoxical aspects of France’s Foucauldian heritage: while several French scholars claim the COVID-19 pandemic is a perfect example of what Foucault called biopolitics, popular reaction instead suggests a biopolitical failure on the part of the government; One of these failures concerns the government’s inability to produce reliable biostatistical data, especially regarding health inequalities in relation to COVID-19. We interrogate whether Foucaldianism contributed, in the past as well today, towards a certain myopia in France (...) regarding biostatistics and its relation to social inequalities in health. Legal responses to battered women who kill have long animated scholarly debate and law reform activity. In September 2012 after 47 years of alleged abuse, Frenchwoman Jacqueline Sauvage fatally shot her abusive husband three times in the back. The subsequent contested trial, conviction for murder, unsuccessful appeal and later presidential pardon of Sauvage thrust the French law of self-defence into the spotlight. The Sauvage case raises important questions surrounding the adequacy of the French criminal law in this area, the ongoing (...) proliferation of gendered stereotypes in law and the need for reform. In the wake of the Sauvage case, this article provides a timely analysis of the gendered law of self-defence in France. Drawing from an in-depth analysis of the judgments imposed in the Sauvage case, this article examines the adequacy of French legal responses to battered women who kill and ignites an argument for further law reform. Der kürzlich verstorbene US-amerikanische Soziologe Robert K. Merton war der prominenteste und einflußreichste Anomie-Theoretiker nach Emile Durkheim. Seine Typologie der Arten individueller Anpassung an anomische gesellschaftliche Situationen bietet heute noch eine wertvolle Grundlage zur Analyse von Gesellschaften. Dieser Beitrag konzentriert sich auf einen dieser Anpassungstypen, den Ritualismus, der Merton zufolge beinhaltet, daß einerseits die kulturellen Ziele, allen voran das des wirtschaftlichen Wohlstands, heruntergeschraubt oder aufgegeben und andererseits die institutionellen Normen zur Erreichung dieser Ziele beinahe zwanghaft befolgt werden. Diese Definition überdenkend (...) versucht der vorliegende Beitrag herauszuarbeiten, daß innerhalb des Systems der Anpassungsformen das Herunterschrauben der kulturellen Ziele nicht das Hauptcharakteristikum ritualistischen, sondern konformen Verhaltens darstellt. Ritualisten haben den Prozeß des Herunterschraubens vielmehr bereits beendet, indem sie jegliche kulturellen Ziele aufgegeben haben, bis auf den einen Wert an sich, nämlich die institutionellen Regeln einzuhalten.Ritualistische Anpassung ist aus Merton`s Sicht für die Soziologie abweichenden Verhaltens, ganz zu schweigen von den Kriminalwissenschaften, nicht von Interesse. Im Gegensatz zu dieser Einschätzung versucht dieser Artikel die verschiedenen soziologischen und sogar kriminologischen Implikationen ritualistischen Verhaltens darzustellen, mit dem Ergebnis, daß Ritualismus sehr wohl ein soziales Problem darstellt. Der Ritualist unterwirft sich nicht nur selbst den institutionellen Normen, sondern fühlt sich auch dazu berufen, andere ständig an die Einhaltung der Regeln zu gemahnen und sie zu überwachen. Deshalb gibt es viele typisch ritualistische Formen abweichenden Verhaltens, wie Denunziation, erzieherischer Tadel oder Mobbing, die sogar in kriminelles Verhalten wie falsche Verdächtigung, Nötigung oder Beleidigung kulminieren können.Am schillerndsten ist die Rolle des Ritualisten in der Kriminalpolitik, nicht zuletzt heute in der Bundesrepublik. Repression jeglicher Art ist seine Antwort auf Regelverstöße und die Kriminalpolitik macht zunehmend Zugeständnisse an ritualistische Forderungen nach härterer und schnellerer Bestrafung oder umfassender Überwachung des öffentlichen Raumes. Ritualisten dominieren den sozialen Diskurs und die allgemeine Wahrnehmung von Kriminalität nicht nur, weil sie wichtige Nutzer und damit Zielgruppe gewisser Massenmedien sind und gerne Leserbriefe schreiben. Sie sind so dominant, weil ihre Art der Anpassung bei zunehmender wirtschaftlicher Krise die Konformität der Wirtschaftswunderzeit zurückgedrängt hat und heute die am weitesten verbreitete in der deutschen Gesellschaft ist. Daher ist auch die schon seit Jahrzehnten zu beobachtende Verschiebung der theoretischen Strafzweckbegründung hin zur Positiven Generalprävention alles andere als ein Zufall. The recently deceased US-sociologist Robert K. Merton has been the most prominent and influential anomie theorist since Emile Durkheim. His typology of modes of adaptation to anomic social situations still constitutes a valuable basis for analyzing society. This contribution focuses on one of these types of adaptation, ritualism, which according to Merton, involves the scaling down or abandoning of the cultural goals, above all economic wealth, on the one hand and to abide almost compulsively by institutional norms to attain these goals on the other. In reconsidering this definition, this contribution attempts to elaborate that within the system of adaptive modes scaling down does not describe the main characteristic of ritualistic behaviour, but first of all characterizes conformity. Ritualists, on the contrary, have already completed the process of scaling down by finally abandoning any cultural goal except the one end-in-itself, that is to comply with the institutional rules.Ritualistic adaptation, in Merton`s view, is of no interest to the sociology of deviant behaviour, not to mention criminal sciences. In contrast to this evaluation this contribution tries to delineate the various sociological and even criminological implications of ritualistic behaviour, leading to the conclusion that Ritualism does indeed present a social problem. The ritualist does not only surrender himself to the institutional means but feels competent to constantly reminding others of abiding by the institutional norms and supervising them. Hence there are many typically ritualistic forms of deviant behaviour like denunciation, disciplinary reproof or mobbing that may even culminate in criminal behaviour like false suspicion, duress or insult.Most ambiguous is the ritualist`s part in criminal policy, not at least in contemporary Germany. Repression of any kind is his answer to breaches of the rules and criminal policy more and more concedes to ritualistic demands for more severe and rapid punishment or extensive supervision of public facilities. Ritualists dominate the social discourse and general perception of criminality, not only because they are important users and therefore the target group of certain mass media, and like to write letters to the editor. They do dominate because in times of increasing economic crisis their mode of adaptation has forced back the conformity of the German economic miracle era and is now the most common one in contemporary German society. Thus, the shift in the theoretical justification of punishment towards a theory of positive general prevention, noticeable for decades, is anything but accidental. (shrink)

In the superannuation/pension industry, ordinary investors entrust their retirement savings to the trustees of the superannuation plan. Investors rely on the trustees to ensure that ethical business and risk management practices are implemented to protect their retirement savings. Governance practices ensure the monitoring of ethical risk management (Drennan, L. T.: 2004, Journal of Business Ethics 52, 257-266). The Australian superannuation industry presents a unique scenario. Legislation requires employers to contribute a minimum of 9% of the employees wage to retirement savings. (...) However, there are no legislated governance standards, although there are standards of recommended governance practices. In this article, we examine the level of voluntary adoption of governance practices by the trustees of Australian public sector and industry superannuation funds. We also assess whether superannuation governance practices are associated with performance and volatility /riskiness of returns. Survey results show that the majority of superannuation plans adopt recommended governance practices supporting the concept of ethical management of the member's retirement savings. The examination of governance principles that impact returns and risk shows that board size and regular review of conflicts are positively associated with return. Superannuation plans with higher volatility in returns meet more frequently. (shrink)

Social change to undermine injustice usually should be pursued through democratic processes. A suitably defined model of deliberative democracy articulates how democracy can produce just policies. As usually understood, however, the model of deliberative democracy focuses too much on argument, privileges unity, assumes face‐to‐face discussion, and assumes a norm of order.

This volume is a collation of original contributions from the key actors of a new trend in the contemporary theory of knowledge and belief, that we call “dynamic epistemology”. It brings the works of these researchers under a single umbrella by highlighting the coherence of their current themes, and by establishing connections between topics that, up until now, have been investigated independently. This volume presents vernacular knowledge as a realm of discourses and beliefs that challenge institutional authorities and official truths. It draws attention to various genres as expressions of alternative knowledge in relation to authority, including traditional and personal experience narratives, life stories, ditties, and jokes. These are transmitted through a wide range of vehicles of expression including online, face to face, social media, forums, networks, and conferences, which are shared and shaped communally but individually articulated and actualised. Vernacular knowledge and (...) vernacular authority also underpin a variety of material culture, rituals and other practices. The volume covers various realms of the supernatural, such as ghosts, saints, spirits, magic, energy lines, and divinations. However, it also discusses beliefs that do not involve the supernatural such as conspiracy theories, politically and ideologically determined creeds, stereotypes and other cases where beliefs appear as socially compelling ideas and challenge prevailing received wisdom. Vernacular religion is examined not only in relation to institutional religion but also to secularism, state sponsored atheism, scientific rationalism and official medicine. Vernacular Knowledge proceeds from the premise that in contrast to institutionally established discourses with monological voicing, the expressive field of vernacular is always heteroglot; it eludes regulation and supervision. Purpose This paper aims to provide a non-academic perspective on the research reports of the JICES “Post-Snowden” special edition, from the viewpoint of a privacy advocate with an IT background. Design/methodology/approach This paper was written after reviewing the country reports for Japan, New Zealand, PRC and Taiwan, Spain and Sweden, as well as the Introduction paper. The author has also drawn on online sources such as news articles to substantiate his analysis of attitudes to technical privacy protection post-Snowden. Findings Post-Snowden, (...) the general perception of threats to online privacy has shifted from a predominant focus on commercial threats to a recognition that government activities, in the sphere of intelligence and national security, also give rise to significant privacy risk. Snowden’s disclosures have challenged many of our assumptions about effective oversight of interception capabilities. Citizens’ expectations in this regard depend partly on national experience of the relationship between citizen and government, and can evolve rapidly. The tension between legitimate law enforcement access and personal privacy remains challenging to resolve. Originality/value As a “viewpoint” paper, this submission draws heavily on the author’s experience as a privacy and technology subject-matter expert. Although it therefore contains a higher proportion of opinion than the academic papers in this issue, his hope is that it will stimulate debate and further research. (shrink)

(That was in response to the reportedly large number of black folks carrying the Republican banner at the 2004 RNC.) The historical irony is that the folks who did the bulk of the selling of black folk would have been predecessors of today’s Democrat party. (So, Maher is evidently no (...) history buff.) Marion Milner introduces this edited collection of her papers from 1942 to 1977 with a fascinating biographical account of her development in psychoanalysis. The collection includes her classic papers on symbolism.

Gains in moral judgement, as measured by the Defining Issues Test (DIT), correlate strongly with advancing education. Curricula that are strongly biblically based may not promote, and students with a strong fundamentalist orientation may not demonstrate, such moral growth. Students at an interdenominational, but very conservative seminary, completed the DIT before and after ethics courses conducted in three different formats. Those students who spent 30 hours in small‐group discussions of ethical dilemmas improved their moral reasoning scores, while those who had (...) fewer hours of discussion or lectures did not. It would appear that small group discussions, shown to improve moral reasoning scores in other educational settings, are also successful in a strongly biblical environment. (shrink)

Reparations whether to blacks for slavery, or to Indians for land theft, or to settle any number of other conflicts, has an interesting political background. Analysts on the left, who are usually no friend of private property rights, nevertheless rely on this doctrine to support their case for reparations. Those on the right, in contrast, who supposedly defend the institution of property rights, jettison them when it comes to reparations. It is only libertarians, such as the present authors, who both (...) favor private property rights in general, and, also, apply them to the issue of reparations, who are logically consistent. Iris Marion Young (1949-2006) was one of the most influential and innovative political theorists of her generation who had a significant impact on a wide range of topics such as democratic theory, feminist theory, and justice. She bridged many longstanding divides among political theorists, engaging in Continental and critical theory, but also insisting on the importance of normative argument: her corpus stands as a testament to the fruitfulness of engaging in both abstract theory and the 'real world' of everyday (...) politics. This volume spans the several decades of her work, illustrating her intellectual development over time through three major areas of innovation: Gender: Maintaining that gender is both conceptually and politically meaningful, Young theorized gender in terms of structures that, in combination, position different people we call "women" in different ways, such that some women have some structures in common, without all women sharing all gendered structures in common. Justice: Young's early writings on a critical theory of justice evolved in her later and posthumously published works where she developed an account of justice that brought together her theorization of structure with her concern to respond to contemporary claims of injustice. The Politics of Difference: Young rejected universal and abstract theories of justice and maintained that justice instead required attending to the experiences of people marked by difference. Given the many issues affecting what occurs in workplaces—where most working people spend most of their time—there is a need for an integrated perspective on work. Esther Reed’s Good Work provides just that: a broader context for understanding the significance of our work.Many people understand “work” to be the energy they expend in order to receive something they can then spend. Such an understanding of work, Reed observes, reflects the assumptions of a capitalist society in which people are valued in terms of what they do and how much money they make. From this standpoint, cardiac surgeons are valued much more highly than garbage collectors, even though societies could not function without garbage removal but did, in fact, survive for centuries before cardiac surgeons. In a similar vein, in the supposedly egalitarian halls of academe, the grossly underpaid adjunct professor is dismissed and discounted even though she spends much more time with students than does her tenured counterpart. [End Page 196]Yet there are other ways of defining work. Reed reminds us that the same Hebrew word translated as “hard work” (‘abad) can also mean priestly service in the Tabernacle (12). The work (or liturgy) of tabernacle worship was understood to be service to God. Likewise, Jesus described his ministry as work and even spoke of the Father as still working: “My Father is still working, and I also am working (Greek ergazetai/ergazomai; John 5:17)” (13). The work of Jesus and his Father had to do with salvation and blessing for human beings. From this standpoint, work clearly has a spiritual dimension.The framework Reed develops for establishing a Christian ethic of work is rooted in the resurrection of Jesus Christ from the dead. What we say about work, she contends, will depend on what we say about the resurrection. Indeed, she argues, reflection on the resurrection can orient (or reorient) the working lives of Christian in important ways (2). An understanding of work rooted in the resurrection, Reed argues, is cultivated by participating in the liturgy of a worshipping community. Many Christian liturgies begin with praise to God for the salvation that comes through Jesus Christ. By beginning worship in this way, the community is able to concentrate on a kind of work that enables them to go beyond their individual lives and become part of something larger—a community in praise of God. In turn, the bread and wine that is blessed during the Eucharistic celebration contains not only the fruits of creation but also the fruits of human labor. As the Spirit of God infuses the bread and wine with the presence of Jesus Christ, crucified and raised from the dead, it also sanctifies our labor. And as we receive the bread and wine, and as we meditate on Christ’s passion and resurrection, we become hungry for enacting justice and mercy in all realms of our lives—including the realm of work. Indeed, through this encounter with the Triune God and with one another in worship, we gain a renewed appreciation of who we are as human beings. Does Descartes belong to metaphysics? What do we mean when we say "metaphysics"? These questions form the point of departure for Jean-Luc Marion's groundbreaking study of Cartesian thought. Analyses of Descartes' notion of the ego and his idea of God show that if Descartes represents the fullest example of metaphysics, he no less transgresses its limits. Writing as philosopher and historian of philosophy, Marion uses Heidegger's concept of metaphysics to interpret the Cartesian corpus--an interpretation strangely omitted from Heidegger's (...) own history of philosophy. Global-scale solar geoengineering raises critical ethical questions, including questions of distributive, procedural, and intergenerational justice. Although geoengineering is sometimes framed as a response to injustice, insofar as it might benefit those most vulnerable to climate-related harms, geoengineering also has the potential to exacerbate climate injustice, especially if control of research, governance, and potential plans for deployment remains concentrated in the hands of a few. The scope and scale of solar geoengineering, the diverse concerns it raises, and the lack of consensus (...) surrounding it pose particular challenges for justice. I argue that addressing these challenges requires an inclusive, dialogical approach that takes seriously diverse perspectives, particularly the perspectives of those who are most affected by climate change and those who have had the least voice in decisions surrounding it. The concept of recognition––as developed in the work of Nancy Fraser, David Schlosberg, and others––offers a normative ground for this approach and can help guide the development of institutions and practices directed toward geoengineering justice. Background Inequities in COVID-19 outcomes in the USA have been clearly documented for sex and race: men are dying at higher rates than women, and Black individuals are dying at higher rates than white individuals. Unexplored, however, is how sex and race interact in COVID-19 outcomes. Objective Use available data to characterize COVID-19 mortality rates within and between race and sex strata in two US states, with the aim of understanding how apparent sex disparities in COVID-19 deaths vary across race. (...) Design and Participants This observational study uses COVID-19 mortality data through September 21, 2020, from Georgia (GA) and Michigan (MI). Main Measures We calculate age-specific rates for each sex-race-age stratum, and age-standardized rates for each race-sex stratum. We investigate the sex disparity within race groups and the race disparity within sex groups using age-standardized rate ratios, and rate differences. Key Results Within race groups, men have a higher COVID-19 mortality rate than women. Black men have the highest rate of all race-sex groups (in MI: 254.6, deaths per 100,000, 95% CI: 241.1–268.2, in GA:128.5, 95% CI: 121.0-135.9). In MI, the COVID-19 mortality rate for Black women (147.1, 95% CI: 138.7–155.4) is higher than the rate for white men (39.1, 95% CI: 37.3–40.9), white women (29.7, 95% CI: 28.3–31.0), and Asian/Pacific Islander men and women. COVID-19 mortality rates in GA followed the same pattern. In MI, the male:female mortality rate ratio among Black individuals is 1.7 (1.5–2.0) while the rate ratio among White individuals is only 1.3 (1.2–1.5). Conclusion While overall, men have higher COVID-19 mortality rates than women, our findings show that this sex disparity does not hold across racial groups. This demonstrates the limitations of unidimensional reporting and analyses and highlights the ways that race and gender intersect to shape COVID-19 outcomes. (shrink)
